13th month pay

Under Presidential Decree No. 851, your 13th month pay is at least one-twelfth (1/12) of the total basic salary you earned during the calendar year.

How do you want to enter your salary?
  • What counts as basic salary: your regular pay, minus unpaid absences. It doesn’t include overtime, holiday and rest-day premiums, night shift differential, cost-of-living allowance, profit-sharing, or the cash value of unused leave, unless your employer treats them as part of basic salary.
  • Who is entitled: rank-and-file employees who worked at least one month during the year, however they are paid. If you resigned or were dismissed before it was paid, you’re entitled to a pro-rated amount.
  • When: on or before December 24.
  • Tax: 13th month pay and other benefits, such as a Christmas bonus, are tax-exempt up to a combined ₱90,000 a year. Only the excess is taxable.

Good to know

How the computations work

  • Night shift differential: at least 10% more per hour for work between 10 PM and 6 AM.
  • Overtime: work beyond 8 hours a day. It earns an extra 25% per hour on ordinary days, and an extra 30% of that day’s hourly rate on rest days, special days, and holidays.
  • Holidays you didn’t work: regular holidays are paid at 100% (200% for a double regular holiday) if you were present or on paid leave on the workday before. Special days follow “no work, no pay” unless your company policy, practice, or CBA says otherwise.
  • Not everyone is covered: these rules generally don’t apply to government employees, managerial employees, field personnel, and certain other workers. Holiday pay doesn’t apply to retail and service businesses that regularly employ fewer than ten workers. Your contract, company policy, or CBA may give you more than the minimum.
  • Source: the multipliers follow DOLE’s guide computations for holiday pay, premium pay, overtime pay, and night shift differential.
